TOPIC - TRAFFIC LANE TICKETS
NYTDA has been working on and addressing the
disappearance of Double Parking Tickets. Many
of you have noticed and complained about
receiving Traffic lane tickets when double
parked. The City has failed to address this issue
and after a thorough investigation and your
support we are now taking measures to have
this situation corrected. Further news will be
made available shortly.
Update: TRAFFIC LANE - OCT 2010
Dear NYTDA Members,
Were you getting Traffic Lane Tickets
(Obstructing Traffic) when you were really Double
Parked?? Of course you were, almost all of the
time!! NYTDA has been working to stop these
practices by the NYC Traffic Division.
As part of our ongoing advocacy for our
members in the trucking & delivery industry, last
year NYTDA filed a notice of claim against the
City of New York with regard to certain ticketing
practices and in particular, this issue. In
response: Effective October 1, 2010, "ALL
PARKING ENFORCEMENT PERSONNEL" were
instructed by the Deputy Inspector that "under NO
CIRCUMSTANCES Should a summons be
issued to a DOUBLE PARKED vehicle for
OBSTRUCTING TRAFFIC"
This obviously does not mean they won't do it
again or correct the wrong done, but in the
meantime, as a result of this, we are finally
seeing double parking tickets issued by traffic
agents instead of traffic lane tickets also known
as obstructing traffic. The reason that this is so
important, is because the law provides for
commercial vehicles to double park for
expeditious delivery and Traffic Lane tickets
improperly issued in their stead do not recognize
this law. Keep in mind, this applies to all areas
of the City of New York except the Midtown core.
We can't stop tickets from being issued... but we
do promise to keep on fighting for you and our
industry for positive change.
Update: May 5, 2011
NYTDA recently filed a federal class action law
suit in the US District Court, E.D. N.Y.
in connection with the previously discussed
issuance ot traffic lane violations in the stead of
double parking tickets by the Traffic Division
between May of 2006 and October of 2010.
NYTDA will report updates as the case proceeds
and we are able, giving consideration to our
responsibilties as lead plaintiff in this action. It is
our hope to resolve this matter in a professional
and responsible manner while seeking proper
remedies by the court for our members and
others similarly situated.

DON'T BLAME THE OFFICER/AGENT
Most of you have from time to time, run into
the occasional bad attitude ticket agent, but
in truth that is the exception. Most officers and
even traffic agents are merely taking the
blame for carrying out bad ticketing policies
and using systems that result in bad
ticketing. Instead of changing the rules and
procedures which cause the tension
between you and the agents, they made it a
felony to assault an agent. Quite honestly,
assault of any kind should probably be a
felony but what has any of that have to do with
the root cause of the tension between New
Yorks Finest and best Police Officers
anywhere (and I will even include traffic
agents) and you, the men and woman simply
trying to deliver the products and services the
City needs and demands?
NYTDA demands that this administration
give back the dignity to our fine officers of the
law and stop making them instruments to
propel finances, let our men and woman in
blue do the job they hired on to do, protect
and serve the citizens of New York Give them
the same respect we do!
